【Overseas Students】Amended Regulations Governing Visiting, Residency, and Permanent Residency of Aliens

Following "Regulations Governing Visiting, Residency, and Permanent Residency of Aliens", the Ministry of the Interior amended and promulgated the Regulations on 27 December 2023 by Order No.11209133831.

The main points of some of the amendments relating to the rights and interests of foreign students are as follows. For the rest, please refer to the Annex ( Regulations Governing Visiting, Residency, and Permanent Residency of Aliens).

• It is amended that the provisions of Article 23 of this Law shall be applied to stateless persons who enter the country with a visitor's visa and apply for residence, and the Immigration Department of the Ministry of the Interior shall consult with the relevant authorities for examination. (Amended Article 6)
• Relaxation of the requirement that foreigners applying for an extension of stay should do so within three months before the expiry of their period of stay. (Amended Article 9)
• Relaxation of the rule that foreigners who come to Taiwan to study may apply for a one-year extension of stay after graduation, and if necessary, may apply for another extension of stay, with a maximum total extension of stay of two years. (Amended Article 11)
• Relaxation of Article 46, Paragraph 1, Paragraphs 8 to 10 of the Employment Service Law for foreigners. In addition to applying for the issuance of an alien residence permit, an alien may also apply for the issuance of a multiple re-entry permit. (Amended Article 20)
